Who completes it
No management company appears for Burke Lake Meadows II Community Association. The register carries the association as its own contact, which ordinarily means a board member or a self-managed office answers a lender questionnaire.
Which form the lender sends
For a planned community or homeowners association that is not a condominium, the agencies publish no project questionnaire at all. The form that arrives is the lender's own, and it concentrates on assessments, the budget, insurance and any litigation rather than on the project.
Anyone who tells you a specific agency form number for a planned community is working from a retired one. Fannie Mae Form 1077, the short form often cited here, was retired in December 2021.
What Virginia sets by statute
A lender questionnaire is not the statutory resale package, and the two are routinely confused. The questionnaire is the lender's own form and is generally neither capped nor timed by statute. The resale package that goes to the buyer is both, and in Virginia it runs as follows.
- Who prepares it
- the association, the association's managing agent, or any third party preparing the resale certificate on behalf of the association (Va. Code § 55.1-2309(B))
- Current charge
- Set by the Common Interest Community Board's published schedule, currently $211.96 prepared on paper or $176.64 electronic, plus $141.31 for an inspection, in force since January 12, 2023
- Update or rush
- $70.66 expedite within five business days if the preparer agrees, $70.66 pre-settlement update, $35.33 per additional hard copy
- Deadline
- 14 days from written request, after which the certificate is deemed unavailable
- Who pays
- The seller, expressly, for preparation, delivery and inspection; the purchaser for a post-closing fee
